Permanent Residency in India
The routes to a long-term, renewable status
India has no ordinary permanent residence route. Long-stay foreigners renew purpose-bound visas indefinitely, and the only settlement-style scheme is a narrow permanent residency status offered to very large investors. For everyone with an Indian family connection, the OCI card performs the function that a residence permit performs elsewhere.
| Ordinary route | None; long-stay status is renewal of a purpose-specific visa source |
| Investor scheme | Permanent Residency Status for substantial investors, on a narrow set of conditions source |
| Practical substitute | Overseas Citizen of India card, for people of Indian origin and qualifying spouses source |
| Registration | FRRO oversight continues for the whole period of stay source |
What does not exist
There is no general residence permit that converts into permanence after a qualifying number of years, no points system, and no category by which an ordinary employee accumulates settlement rights. A foreign professional who works in India for a decade holds, at the end of it, an employment visa due for renewal.
This is not an administrative oversight but the shape of the policy. India's long-stay categories are defined by purpose, and when the purpose ends the basis of stay ends with it.
The investor scheme
The government introduced a Permanent Residency Status scheme for foreign investors, conditioned on investing a large sum within a defined period, on the investment generating a specified number of jobs for Indian citizens, and on the investor being a national of a country with which such arrangements are permitted. The thresholds are high enough that the scheme has been used by very few people.
Where granted, the status is issued for a long fixed term and is renewable, and it carries limited rights to acquire residential property for the holder's own use. It is not citizenship and does not confer political rights.
How the categories compare
| Status | Right to live indefinitely | Right to work |
|---|---|---|
| Employment visa | No, renewal each period | Yes, with the sponsoring employer |
| Entry or X visa | No, renewal each period | No |
| Student visa | No, course duration only | No |
| Permanent Residency Status | Long fixed term, renewable | Yes, within the invested venture |
| OCI card | Yes, lifelong | Yes, most occupations |
The OCI card as the practical answer
For anyone eligible, the OCI card removes the entire apparatus. It carries a lifelong multiple-entry visa, exemption from FRRO registration for any length of stay, and parity with resident Indian nationals in most economic and educational matters. It is described in detail under Citizenship, because the reason it exists is that citizenship itself is closed to dual nationals.
